Service Agreements
Service Agreements
- Service Agreements outline the relationship between the strata manager and the strata corporation.
- These agreements can be amended (changed).
- Standard forms can be found at https://stratapropertyagentsofbritishcolumbiaspabc.wildapricot.org/
- This is known as the SPABC (Strata Property Agents of British Columbia) and acts as a repository for these agreement templates.
Situations Of What Entities Are Entering Into A Service Agreement
These are the “Rules” under the Real Estate Services Act. However, these rules would be waved by the client. Assuming that hasn’t happened then there are 3 situations:
- The agreement must be in writing and entered into before ANY services are performed by the brokerage.
- The agreement of the management fee needs to be agreed on as authorized in the budget.
- Typically the services contract will be between the Brokerage and the Strata Council (on behalf of the strata corporation.
- The Strata Corporation has the authority to enter into a contract for Strata Management services contract with a Brokerage and doesn’t need to pass a resolution for these services. But this must be clear in the budget prior to providing any services.
Full Disclosure
If there is an executive member that has an interest in the strata management contract, this has to be disclosed and cannot cast a vote with regards to the services agreement contract.
The next situation could be;
Between the Brokerage and a strata Executive of a Section. This means that a section could have a Strata Management Services agreement with a different Brokerage than the main Strata Corporation.
The Services Agreement could also be made with the Owner / Developer
Before the transfer of the first strata lot;
- If after the sale of a first strata lot. This agreement must be in place before the first AGM and the strata manager cannot be the owner-developer and is not at arm’s length with the developer. This reduces the potential for conflicts of interest down the road.
