Common Law in Leases
A Common Law rule that states “no estate in land passes until the tenant enters into possession of the leased premises”.
Commercial Tenancies
There is an implied right to allow the tenant possession of the leased premises at the beginning of the agreed-upon and signed lease term. If the landlord of a commercial property does not allow a tenant to take possession, he will be found liable. The tenant’s only course of action at this point would be to sue for damages. This is because the recourse of other remedies, such as specific performance (being let into the premises) do not start until the tenant is actually in possession.
Residential
This has been abolished in residential cases by the Residential Tenancy Act. If the Landlord did not follow through with allowing entry at the start of a lease term, the tenant would get an “order for possession” and is not limited to damages.
Commercial
Quiet enjoyment does not mean freedom from noise. Instead, it means:

The assurance of the consequences of a defective title.

If anyone claims to have received rights from the landlord, which affects the tenant’s rights to the premises, it would be a breach of the covenant of quiet enjoyment.

Also assures that the tenant has the use and enjoyment of the premises without interference from the landlord.
Residential
A residential tenant is entitled to Quite Enjoyment in the following ways:

Freedom from unreasonable disturbance.
-
Use of common areas for the reasonable purpose free from interference.
-
Reasonable privacy.
-
Exclusive possession of the rental unit.
Residential

The landlord has a duty to repair both furnished and unfurnished residential premises that comply with safety standards irrespective of the condition of the premises at the time the lease was entered.

Therefore, if the tenant moves in and later discovers the stairs need to be repaired, the landlord must get the work done within a reasonable amount of time.
Commercial

Each lease is drafted differently, however, there is an implied condition that if renting out a furnished dwelling, any leased furnished space must be reasonably fit for human habitation.

This does not apply to unfurnished premises.
Residential

Tenants must maintain a reasonable standard of care throughout the rental unit and property. Anything that the tenants break out of neglect or tenant action does need to be repaired by the tenant, or the landlord will have to be reimbursed if landlord has to pay outright.
Commercial

It is agreed that the tenant will treat the premises in a tenant-like manner.

A tenant must do odd jobs to keep up and deliver the premises in the way that they were found when they moved in.
